One of those pieces of paper should be entitled Notice of Revocation and Temporary License. This paper now functions as your driver’s license and lasts for a period of 15 days. What are the penalties for DUI? There are a wide range of penalties for DUI’s depending on whether or not you have prior offenses, how high your breath or blood test was, and the surrounding circumstances of your arrest.

For example, a 1st Offense Non-Aggravated DUI in Nebraska is a Class W Misdemeanor. This means your test was below a .150, and the penalty range for such a conviction if you do not receive probation includes:

  • Maximum 60 days in jail and a $500 fine
  • Mandatory Minimum 7 days in jail and $400 fine
  • License Revocation of 6 months
  • And you must apply for and obtain an Ignition Interlock Permit (IIP) to drive during your revocation period

If you do receive a probation sentence you will be subject to the following:

  • 0 days in jail and a $500 fine
  • License revocation of 60 days
  • And again you must apply for and obtain an IIP.

Compare that to a 3rd Offense Non-Aggravated DUI in Nebraska, which while also being a Class W Misdemeanor, carries a significantly higher penalty range for jail and probation. For jail the range includes:

  • Maximum 1 year in jail and a $1000 fine
  • Mandatory Minimum 90 days in jails and $1000 fine
  • License revocation of 15 years
  • You will also have to obtain an IIP and comply with restrictions imposed by the DMV

If you are fortunate enough to receive probation you will be subject to:

  • 30 days in jail
  • $1000 fine
  • License Revocation of 18 months to 15 years

As you can tell, DUI’s can be complicated and there are a wide range of penalties available to the Judge should you be convicted and sentenced for a DUI.
