FAQ
New Client,
Thank you for trusting us with your case. This document should be used by you throughout your case to answer frequently asked questions, and to manage what you should expect from our office and what we expect from our clients. We look forward to working with you to reach the best possible outcome of your matter.
What generally happens after the client has hired Miltenberger Law Offices (MLO)?
Once we have been hired to work you case, we will notify the court that we are your attorney, and we will request copies of the documents pertaining to your case. In doing so, we must sign agreements that we will not disseminate the police reports to anyone including to you, our client. You are able to review your reports in person at our office, or by setting up an online meeting to review. WE CANNOT SEND YOU A COPY OF YOUR REPORTS.
How can I make sure I have provided everything MLO needs on my case?
We need to know what happened from your perspective. Please provide us detailed information in your initial consultation and any subsequent meeting. It never hurts to take notes about what you recall as close to the incident as possible, this will allow you to have reference material from when your memory is fresh regarding the incident.
How do I get documents to MLO? What if MLO needs me to sign a document?
On nearly every case, we will need to you to be able to sign multiple documents. To best do so, we will need you to have access to email. We will send you documents that can in most cases be signed online. In some jurisdictions, you will be required to have a notary present when you sign your documents. You can generally locate a notary at your local bank.
Our e-signature documents will be sent to you from either PracticePanther, our case management system, or via Abobe. Please review and sign documents immediately upon receipt.
How often should the client expect to hear from MLO regarding my case?
We understand that knowing about your case and how it is progressing is of top priority. You should expect to hear from us within 48 hours of any call to our office regarding your questions. We will generally only communicate with the client directly or ONE person designated and approved by the client to receive communication. It is not productive to be contacted by numerous parties regarding your case, and in most cases communicating with anyone regarding the specifics of your case is prohibited by the Attorney/Client Privilege.
Additionally, you should expect to hear from our office regarding any major milestones in your case including: new court dates, changes in court dates, plea offers extended by the prosecution, and any other important developments in your case.
We are unable to communicate with you on a daily basis regarding your case. Criminal cases take on average 6 months or more to resolve. Felony cases often take longer. Checking in on your case with our office when your court date is nearing, usually with in one week of any date is the most efficient way to maintain contact. As always, when you have questions, contact us and we will get back to you as soon as possible.

What can the client do to assure that they are receiving the necessary contact with MLO?
The most important thing you can do is assure that you have fully and accurately completed the Client Intake that is provided to you at the outset of your case. You can fill this document out in person at our office or can fill it out online when it is sent to you via our case management system PracticePanther. WE MUST HAVE ACCURATE ADDRESS, PHONE AND EMAIL TO COMMUNICATE WITH YOU EFFICIENTLY. If any of your contact information changes, please let us know immediately.
How can the client verify when they have court?
Keeping track of your court dates is of the utmost importance. First, make sure we have your correct address, as we will mail you notification of your next court dates. If you need information regarding when your next court date is please call the main line of our office at 402-341-3400.
What can I do to assure the best possible outcome on my case?
Each case is different, so be sure to ask this question early on in your case. Getting started on any recommendations from MLO is imperative to putting us in the best position to reach a successful outcome in your case. For example, if you have been charged with a crime involving alcohol or drugs you should immediately consider obtaining a Substance Abuse Evaluation and attending AA/NA Meetings. If your case involves restitution to an alleged victim you should prepare to save for a restitution payment in the event it will assist in resolving your case. If you case involves assault charges, you should consider participating in an Anger Management Class or Counseling Services to address the root cause of the situation. PARTICIPATING IN THESE TYPES OF PROGRAMS IS NOT AN ADMISSION OF GUILTY, BUT IT DOES PLACE YOU IN THE BEST POSSIBLE POSITION TO GET A POSITIVE OUTCOME IN YOUR CASE.
